Update March 13, 2013

On December 2012, Zimmerman/Reed filed the original class action lawsuit in California state court challenging Norcold, Inc., Thetford Corp. and Dyson-Kissner Morgan Corp. for failing to disclose all material facts regarding inherent defective Norcold gas absorption refrigerator products. That case was only filed on behalf of a class consisting of California and Florida residents. No other states were included. Since then other RV/gas absorption refrigerator owners from other states contacted our office about joining the case and pursuing claims for residents of other states. We have now drafted, and are in the process of seeking permission from the Court to file an amended complaint expanding the putative class to one including residents of California, Florida, Texas, New York, Pennsylvania, Maryland, Tennessee, Mississippi, Oregon, North Carolina, Washington, Illinois and Arizona. These are the only states that can pursue claims at this time. If you reside in one of these states we will seek to have the Court certify the class to allow us to pursue damage claims on behalf of yourself and other residents of these states who owned or purchased Norcold series 6, 8 or 1200 series refrigerators during the applicable limitations period.

* The complaint asks for losses relating to fixing and/or replacing the faulty refrigerator and additional depreciation of your RV as a result of having a Norcold unit. Items NOT COVERED in the lawsuit are losses for personal injury and separate property damage.

Samsung Refrigerator Recall

Samsung models so far: RF266AASH, RS263BBWP, RB1955SH, RS2533SW, RS267LASH, RS267TDRS, and RS2630WW. There may be more added later.

I called Zimmerman/Reed for an update today. Stacy tells me there is an update letter going out in several days with details. The bottom line is the class action lawsuit is very much alive and proceeding as quickly as legal matters of this type can. Someone had surfaced the idea that lawyers can get bought out with a cash settlement from the company(s) targeted. Stacy assured me this isn't the case here. I will update this thread as information becomes available. Don't look for anything to happen in the way of resolutions to this until after 1/1/2014.

Update for May 8, 2014 with summary points below:

Spoke with Stacy Bethea (480) 348 - 6400 From Zimmerman Reed Scottsdale, AZ office.

They are still in need of more participants.

1) Court date class certification postponed to June 13, 2014.

2) Still looking for owners of coaches 2009-present w/Norcold problems and/or fires.

3) Owners of older coaches are still being included.

Please either visit Zimmerman Reed Law Firm online and enter Norcold in their case search or phone Stacy directly (# above).

Currently the case is in a holding pattern until the court date arrives. No other new information is available at this time.
